GENERAL

The following terms and conditions (henceforth: the Terms and Conditions”) are valid between you and Tom Wood AS (Reg. No. 911 705 389 Norway) (henceforth: TOM WOOD; may be referred to as “us” and “we”) and apply to all use of and orders placed on the TOM WOOD website tomwoodproject.com, and orders made by telephone, e-mail or by live chat with TOM WOOD’s Customer Service team (henceforth together: the “Website”). Please note that Tom Wood does not guarantee that all products presented on the Website are in stock or are available for purchase. TOM WOOD reserves its right to stop selling a product. Orders can only be placed by persons that are 18 years or older. TOM WOOD reserves the right to revise the Terms and Conditions at any time. The date of the latest update is found in the final section of the Terms and Conditions. Users are responsible for keeping themselves updated with such changes. Please note that the terms and conditions valid for your order are always the terms and conditions that are in effect as of the time that you have placed your order and not a later version. You should keep a copy of these Terms and Conditions for future reference.

Please read these terms and conditions carefully before submitting your order to us on the Website. These conditions tell you who we are, how we will supply the products to you, how you and we can change or terminate the contract, what to do if there is a problem and other important information. If you do not agree with any of the terms of these terms and conditions, the Privacy Policy or the Terms of Use, please do not place an order on the Website.

PLACING AN ORDER

By using the Website and/or placing an order on the Website, by telephone, e-mail or by live chat you confirm that you have read the Terms and Conditions and the Privacy Policy, and that you accept them; if you do not accept these Terms and Conditions and Privacy Policy, do not place an order. Please make sure that you have read and understood the Terms and Conditions before you place an order. Before you place your order, you will be given the opportunity to review your selections, the information you have provided, the total price of your order and correct any input errors. Please note that products in your shopping bag are not reserved and may be purchased by other customers until you have placed the order at checkout and received the order confirmation email. If prolonged inactivity causes your connection to the Website to fail, your selection of products may be lost. In such a case, you will be required to re-enter your selection of products to the shopping bag.


ACCOUNT

All orders placed on Tom Wood website, tomwoodproject.com, are stored in our customer system. The information being saved is the customer’s shipping and billing address, as well as their order history.

You can choose your own password to log in. Here you can view your own profile which contains order history and information such as customers shipping and billing address. All profiles can be deleted by contacting us at hello@tomwoodproject.com.


ORDER CONFIRMATION

After submitting your order, we will send you an order confirmation email with your order number, details of the product you have ordered from us, your payment details and delivery details. Please note that the confirmation e-mail is an acknowledgement that we have received your order and is not an acceptance of the order. If you fail to receive an order confirmation within 24 hours of placing an order, please contact us at hello@tomwoodproject.com.


ACCEPTANCE AND SHIPPING CONFIRMATION

Please note that all orders placed by you are subject to availability. Once the order has been processed, a shipping confirmation email will be sent with all relevant information about your order. The shipping confirmation or pick-up notification is our acceptance of your order. Please note that TOM WOOD does not guarantee that all products presented on the Website are in stock at the time of your order. If a product is unavailable, we will contact you shortly, by phone or by email. If we have already received payment for such a product, we will refund you the amount of the purchase.


PRICES

The prices and delivery costs shown on the Website include sales tax/VAT. The prices may vary between the physical store and the Website. Please also note that TOM WOOD may cancel the order even if it has been accepted by TOM WOOD under the condition that you realise or should have realised that the price information was incorrect. The delivery costs are shown in connection with the shipping methods at the checkout stage.

Prices are shown in NOK, SEK, DKK, USD, EUR, GBP and JPY. When first entering the site you get the option between these currencies. The preferred currency can also be changed later. Prices do not include service, payment and delivery charges.

If the package is not picked up by the customer and it incurs costs as a result of this, the customer is liable for the additional costs and will be charged all costs and expenses associated with the return shipment. This includes shipping costs, taxes, fees for pre-payments, return costs, or any other added charges.

By pre-orders and custom-made orders, the card will be charged on beforehand. In such cases, you will be notified by email.


PERSONALISED ITEMS

Personalised items are made to order and cannot be returned or exchanged. Once the order has been sent by the customer and confirmed by TOM WOOD, the customer will be informed via an order confirmation email. Once the order is processed and accepted, the customer will receive a shipping confirmation email. Personalised items may be delivered in a time slot indicated on the site which may be longer than regular delivery slots. Because of the clearly personalised nature of personalised products and the fact that they are produced specifically for the customer, they cannot be returned, refunded or exchanged. Similarly, the customer does not have the right to cancel the order.


PAYMENTS

The following payments are accepted:

CREDIT CARDS AND DEBIT CARDS

Payment can be made by the following credit cards: Visa, Mastercard and American Express. Payment can also be made by the following debit cards: Visa and Maestro. (Maestro and Visa Electron: please check with your bank to make sure your card is valid for online purchases). The purchases made with Visa and Mastercard are verified by a secure code. Please note that your card is debited with the purchase amount once TOM WOOD has sent you the order confirmation email. We do our best to make the Website as secure as possible. All credit/debit card transactions on the Website are processed using Adyen, a secure online payment gateway that encrypts your card details in a secure host environment. Payment will be debited and cleared from your account upon acceptance of your order by TOM WOOD. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorise payment to TOM WOOD, your order will be cancelled. We are not responsible for any charges or penalties which may be imposed by the payment provider as a result of payment being processed in respect of your order.

PAYPAL

When selecting the PayPal option, you will be directed to the PayPal site to “Log In” and review the amount shown 

before clicking “Pay Now”. Once this transaction is complete, you will then return to the Website.


DELIVERY

SHIPPING METHODS

We offer different shipping methods to meet your needs as further specified when you check out. Dispatch of orders may take up to 7 business days but we aim to dispatch all orders within 24 hours during weekdays, or 1-2 business days during sales periods. Please note that delivery times are provided as guidelines only, and commence from the date of dispatch. The delivery times do not take into account possible delays caused by payment authorization and/or stock availability. If TOM WOOD fails to deliver within 30 days, you may have the right to cancel the purchase. Your order will be delivered by DHL Express to the shipping address you have indicated, or to the store you have indicated if you have elected to collect in store.

We participate in DHLs Go Green environmental protection program to reduce the logistics-related emissions. Their goal is to reduce the CO2 emissions to zero by 2050. Read more about their initiatives here.

All orders are sent with DHL Express Go Green and will be delivered to your delivery address or your local delivery point. Delivery notification will be sent via sms when your package is on its way. A shipment that is not collected within 14 days will be returned back to us. A new shipment can be arranged for an additional shipping fee.


FIRST-TIME ORDER POLICY

For security purposes, TOM WOOD reserves the right to ship first-time orders to the cardholder's verified billing address or work address. To avoid delays in receiving your order, please make sure to provide the correct billing and shipping information associated with your credit/debit card when placing an order.

RETURNS AND EXCHANGES


RETURN POLICY 

Tom Wood has a 30-day return policy. You have 30 days from when you received your order to ship it back to our return centre for a refund. If your order is shipped back to us outside of this time-window, we will return the shipment to you.

Please note that the product(s) must be returned through our return system, Turnr. The system will then provide you with a DHL shipping label which can be attached to your re-sealed parcel, to ship it back to us. 

There will be a return shipping fee withdrawn from the refund amount. Please see specific prices for return shipments, depending on your location, under Return Costs.

In order to accept your return, the product(s) must be returned in perfect condition, bearing no signs of wear and tear, in its original packaging, undamaged and unworn. 

If you have ordered multiple products, make sure to put them in their original, corresponding plastic bag. Putting numerous products in the same bag can lead to scratches and denting, potentially affecting our possibility of accepting the return. 

Returns are closely inspected upon delivery and we reserve the right to refuse any items that do not match these criteria.

If you purchased a Tom Wood piece from another retailer, please consult the retailer directly in regard to their policies. Tom Wood is not responsible for products purchased from other retailers.

HOW TO RETURN

To initiate a return, please reach out to our customer service team by clicking on the "Help" bar on the right hand side of your screen, and start a chat. Alternatively, you can also email us at hello@tomwoodproject.com. We are here to assist you with any inquiries regarding returns.

Please note that return shipments are at the customer’s own expense. This amount will be deducted from the final refund.

EXCHANGES 

Please note that Tom Wood does not offer any exchange services. Should you wish to change the sizing of a product, or receive another product entirely, a new order will need to be placed, independent of the refund process of your original order.

Exceptions are only made in cases wherein the product(s) is faulty, or the wrong piece has been delivered to the customer. 


IMPORTANT INFORMATION

  • All returns must be sent with DHL Worldwide Express, and you receive a return label through contacting hello@tomwoodproject.com. Tom Wood is not responsible for product(s) sent with a third party delivery service. 

  • The customer is responsible for the goods until it has been delivered to DHL either by pick up or delivered at a service point. Always keep the shipment receipt and tracking number for proof of shipment and for tracking. 

  • Returns are closely inspected upon delivery and we reserve the right to refuse any returns that do not match these criteria. Please note that Tom Wood only issues a full refund if the product is in the same condition as at the time of delivery. A deduction of the value might be made if the return item is not returned in perfect condition.

  • If the item is returned due to a claim or we have sent you the wrong item, the full amount including shipping costs will be refunded.

  • Collecting or returning orders placed at the online store at Tom Wood Store in Oslo is unfortunately not yet available.

  • There are no returns on made-to-order products or solid gold items.


DEFECTIVE PRODUCTS

If you receive defective products, please notify us immediately and within a reasonable time after you have detected that the products are defective. If TOM WOOD reasonably determines that the products are in fact defective, TOM WOOD reserves the right to send you a non-defective identical replacement item or make a full refund to you, including shipping costs.


QUALITY & WARRANTY GUARANTEE

These warranty regulations are designed in accordance with the Norwegian Consumer Purchase Act and apply to the purchase of jewellery and rings from www.tomwoodproject.com. The guarantee is in addition to your rights as a consumer under the law.


GENERAL WARRANTY PERIOD

Tom Wood offers a general warranty of two years from the date of purchase for all our jewellery, bracelets, earrings and rings.


WARRANTY COVERAGE

  • Material and manufacturing defects: The warranty covers material and manufacturing defects that occur within the warranty period. This includes errors in material and finishing, welding, stone setting, and the like.

  • Defects covered by the guarantee: 

    • Defects in structure or design that affect the product's functionality. 

    • Improper functioning of locks, hinges or other accessories. 

    • Loss or loosening of stones as a result of incorrect stone setting.

  • Warranty requirements: To use the warranty, you must contact us within a reasonable time after the fault or defect has been discovered. We reserve the right to assess each individual warranty claim.


WARRANTY OBLIGATIONS

Repair or replacement: 

In the event of a valid warranty claim, we will either repair the product, or replace it with an equivalent product, at no additional cost to the customer. We reserve the right to repair the product up to three times before considering a refund.


REFUND

If repair or replacement is not possible, or if this entails unreasonable costs, you are entitled to a price reduction or a full refund in accordance with current legislation.


LIMITATIONS IN THE WARRANTY

Normal wear and tear: 

  • The warranty does not cover wear and tear that occurs as a result of normal use and ageing.

Abuse or negligence: 

  • The warranty does not cover damage caused by abuse, negligence, accidents or lack of maintenance.

Unauthorised alterations: 

  • The warranty does not cover jewellery or rings that have been altered, repaired or adjusted by anyone other than Tom Wood or our approved third parties, as agreed.

External damage: 

  • The guarantee does not cover damage caused by external factors such as accidents, fire, natural damage or other external influences. Other external influences include examples such as damage to paving caused by negligent behaviour or accidents.

Violation of instructions for use: 

  • The warranty does not cover damage that occurs as a result of violations of instructions for use and recommendations for maintenance, for example attempted cleaning of products with harmful chemicals, or similar.

Specific Wear and Tear:

  • Scratches and contact marks; caveat for loss of stones due to wear; groping for colours, on metals and stones via chemicals; wear and tear on locks, hooks and the like over time; naturally occurring gloss reduction on surfaces.

TOM WOOD RESPONSIBILITY

TOM WOOD liabilities to you are limited in each separate case to these Terms and Conditions unless otherwise is stipulated by law. In no case whatsoever will TOM WOOD assume any liability for indirect damages such as loss of profit or in case of force majeure such as war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events. PROVISIONS SEVERABILITY

If any part of these Terms and Conditions are held to be invalid or unenforceable, such determination shall not invalidate any other provision of these Terms and Conditions; instead the invalid terms and conditions shall be replaced with other terms in order to give effect to the commercial intentions of these Terms and Conditions.


JEWELLERY CLAIM POLICY

COVERAGE

Our claim policy covers material and manufacturing defects, as outlined in section 2 below.


COVERED EFFECTS

Material and Manufacturing Defects:

  • Errors in material and finishing due to manufacturing, including welding and stone setting.

Defects Covered by the Guarantee:

  • Defects in structure or design that affect the product's functionality.

  • Improper functioning of locks, hinges, or other accessories.

  • Loss or loosening of stones as a result of incorrect stone setting.


EXCLUSIONS

This policy does not cover the following:

Normal Wear and Tear:

  •  Wear and tear resulting from normal use and ageing.

 Abuse and Negligence:

  • Damage caused by unintentional or accidental breakage, abuse, negligence, accidents, or lack of maintenance.

Unauthorised Alterations:

  • Jewelry altered, repaired, or adjusted by unauthorised parties.

External Damage:

  • Damage caused by accidents, fire, natural disasters, or other external influences.

Violation of Instructions for Use:

  • Damage resulting from violations of instructions for use and maintenance.

Specific Wear and Tear:

  • Scratches, contact marks, colour changes, gloss reduction, or wear and tear on locks, hooks, and similar parts over time.


CLAIM WARRANTY REQUIREMENTS

To initiate a claim under this warranty, the customer must:

  • Contact us within a reasonable time after discovering the defect or fault.

  • Allow us to assess each individual warranty claim.

We reserve the right to review and determine the validity of each claim based on the terms and conditions outlined in this policy.

CLAIM PROCESS

Notification:

  • In the event of a covered defect, the customer must notify us promptly through our designated contact channels or customer service.

Providing Evidence:

  • The customer may be required to provide relevant evidence of the defect, such as photographs or other requested documentation.

Assessment:

  •  Upon receiving the claim and necessary evidence, we will conduct a thorough assessment of the defect to determine its eligibility for coverage.

Approval and Resolution:

  • If the defect is approved under our claims policy, we will proceed with the necessary actions to remedy the defect, which may include repair or replacement, at our discretion.

Customer Cooperation:

  • The customer must cooperate with us during the claim resolution process, providing any requested information or access to the product for assessment and repair.

Shipping and Costs:

  • Shipping and any associated costs for sending the item for assessment/claim or repair will be borne by us unless explicitly stated otherwise.


CLAIM WARRANTY PERIOD

Duration:

  • The claim warranty period for covered defects is 2 years from the date of purchase.

Commencement:

  •    The claim warranty commences on the date of purchase as indicated in the purchase invoice or receipt.


LIMITATIONS OF LIABILITY

 Maximum Liability:

  •  Our maximum liability under this policy is limited to the original purchase price of the jewellery.

Consequential Damages:

  •  We shall not be liable for any consequential, incidental, or indirect damages arising from the use or inability to use the jewellery.


By initiating a claim under this policy, the customer agrees to abide by the terms and conditions outlined herein.

CLAIMS RESOLUTION


CONTACT TOM WOOD FIRST

If a dispute arises between you and TOM WOOD, our goal is to learn about and address your concerns. You agree that you will notify TOM WOOD about any dispute you have with TOM WOOD regarding these Terms & Conditions by contacting TOM WOOD.


BINDING ARBITRATION

You and TOM WOOD agree, subject to section 26(G) (Protection of Confidentiality and Intellectual Property Rights), to submit any claim, dispute, action, cause of action, issue, or request for relief arising out of or relating to these Terms & Conditions or your use of the Products and/or Subscription Services to binding arbitration rather than by filing any lawsuit in any forum other than set forth in this section. Further you agree arbitration is final and binding and subject to only very limited review by a court. You also waive your right to any form of appeal, review or recourse to any court or other judicial authority, insofar as such waiver may be validly made.

This provision is intended to be interpreted broadly to encompass all disputes or claims arising out of or relating to your use of the Products. Subject to section 26(G) (Protection of Confidentiality and Intellectual Property Rights), any dispute or claim made by you against us or us against you arising out of or relating to these Terms & Conditions or your use of the Products(whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory) will be resolved by binding arbitration except that you may take claims to small claims court if they qualify for hearing by such a court.


ARBITRATION PROCEDURES

You must first present any claim or dispute to TOM WOOD by contacting us to allow us an opportunity to resolve the dispute. You may request arbitration if your claim or dispute cannot be resolved within 60 days after presenting the claim or dispute to TOM WOOD. TOM WOOD may request arbitration against you at any time after it has notified you of a claim or dispute in accordance with section 27(Notifications).

The arbitration of any dispute or claim shall be conducted in accordance with the then current and applicable rules of the American Arbitration Association as modified by this agreement. The place of any arbitration will be Oslo, Norway, and will be conducted in the English language. Claims will be heard by a single arbitrator. The arbitrator may not award relief in excess of or contrary to what this agreement provides, order consolidation or arbitration on a class wide or representative basis, award punitive or consequential damages or any other damages aside from the prevailing party’s actual damages, or order injunctive or declaratory relief, except that the arbitrator may award on an individual basis damages required by statute and may order injunctive or declaratory relief pursuant to an applicable consumer protection statute.

Any arbitration shall be confidential, and neither you, nor TOM WOOD nor the arbitrator may disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of enforcement or appeal of the arbitration award. Judgement on any arbitration award may be entered in any court having proper jurisdiction. If any portion of this arbitration section is determined by a court to be inapplicable or invalid, then the remainder shall still be given full force and effect.


NO CLASS ACTIONS

There shall be no right or authority for any claims subject to this arbitration section to be arbitrated on a class action or consolidated basis or on bases involving claims brought in a purported representative capacity on behalf of the general public (including, but not limited to, as a private attorney general).


FEES AND EXPENSES

All administrative fees and expenses of arbitration will be divided equally between you and TOM WOOD. Each party will bear the expense of its own counsel, experts, witnesses and preparation and presentation of evidence at the arbitration hearing.

YOU MUST CONTACT TOM WOOD WITHIN ONE (1) YEAR OF THE DATE OF THE OCCURRENCE OF THE EVENT OR FACTS GIVING RISE TO A DISPUTE, OR YOU WAIVE THE RIGHT TO PURSUE ANY CLAIM BASED UPON SUCH EVENT, FACTS, OR DISPUTE.

Protection of Confidentiality and Intellectual Property Rights. TOM WOOD may provide notifications to you as required by law or for marketing or other purposes via (at its option) email to the primary email associated with your TOM WOOD account, hard copy, or posting of such notice on the TOM WOOD website. TOM WOOD is not responsible for any automatic filtering you or your network provider may apply to email notifications. GOVERNING LAW

This agreement shall be governed by, construed and enforced in accordance with the laws of Norway, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to these terms, or any items purchased from TOM WOOD, shall be filed only in the courts located in Oslo, Norway and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action, unless such action is required to be arbitrated as set forth in an above section.


COMPLETE AGREEMENT

Except as expressly provided in a particular “legal notice” on the site, these terms & conditions, together with the privacy policy, constitute the entire agreement between you and TOM WOOD with respect to use of the site and content.
